Terms of Use — The Botanical Eye

Last updated: 9 October 2026

1. Who we are and acceptance

These Terms govern your use of the mobile app The Botanical Eye (“the app”), provided by Aissa Bamogo Redondo, sole trader, Spain (“we”, “us”; contact: aissa.b.code@gmail.com). By downloading or using the app you accept them. If you do not agree, do not use the app.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these Terms and the usage rules of the store you got it from (the Apple App Store or Google Play). On iPhone, Apple’s standard licence (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies.

3. Free use and Premium

A limited number of free plant scans is included each week. Premium removes that limit and is offered as an auto-renewable subscription, monthly or yearly.

4. Codes and free access

Promotional and partner codes are the stores’ own (Apple offer codes and Google Play promo codes). They are redeemed in the App Store or Google Play, follow those stores’ rules (for example, usually for new subscribers only and once per person) and have no cash value. We may also give free Premium to people we choose; that access is a gift we may end at any time.

5. AI results — important

Plant identifications, health assessments and care tips are generated automatically by artificial intelligence and may be wrong or incomplete. They are for general information only. Do not rely on the app to decide whether a plant is safe to eat, touch, or keep near children or pets. Some plants are toxic. Always check with a qualified professional — a botanist, horticulturist, doctor or vet — before acting on anything that matters, especially in cases of ingestion, allergy or possible poisoning.

6. Acceptable use

You agree not to use the app unlawfully; not to reverse engineer it except where the law allows; not to interfere with the app or the servers it relies on; not to submit images you have no right to use or that show other people without their consent; and not to try to get around usage limits or access features you have not paid for.

7. Intellectual property

The app, its design, text, graphics and logos belong to us or our licensors. Photos you take remain yours; you let us process them only to provide the analysis.

8. Third-party services

The app relies on Google’s Gemini API (analysis), Supabase (backend), RevenueCat (subscriptions) and the app stores. Their terms may also apply. See the Privacy Policy for how data is handled.

9. Liability

The app is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential damage, or for harm resulting from relying on AI results. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer.

10. Changes and termination

We may update these Terms; the date above shows the latest version, and material changes will be announced in the app. We may suspend access if you breach these Terms. You may stop using the app at any time.

11. Law and disputes

These Terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules of the country where you live. Consumers in the EU may also use the online dispute resolution platform: https://ec.europa.eu/consumers/odr.
